Planning is important. It isn't just when you are in crisis... in fact, planning avoids crises. Studies have shown that people who are prepared for the future, and for long term care in particular, are less likely to need Medicaid. So, while we sometimes refer to this planning as Medicaid Planning, it might be better to call it "Anti-Medicaid Planning"! Here are some questions you should be asking in planning:

• Is your will up to date?
  • Have you moved since it was last completed?
  • Did you consider new children, divorces, or special needs in your family?
    
• Do you need a trust?
  • Do you need or desire a trust for your children or parents to be established?

When you are facing a major life crisis and you realize that you don't know who will get your money, your estate, your precious coin collection... or, who will take care of your children. What can you do?

Estate Planning Fee Schedule

While no fee schedule can completely cover the issues and nuances that could be found in a will or a complete estate plan, the following illustrates the fee schedule for several documents. When you come in to talk with me (this first consultation is free), we will go over your current situation, identify the probable issues, and create a package proposal for you or your family. The fee will be fair and reasonable ... legal services may seem expensive, but you are planning for a future that could, without a plan, consume all of what you have.

Wills

• Simple Will -- $1,400.00
• Will with a single Trust, or spousal simple Wills -- $2,000.00 -- $3,500.00
• Complex Wills, including Trusts, Special Needs, Guardian Ad Litem, etc. -- $3,500.00 plus $250/hour beyond Initial Planning

Powers of Attorney

Each of these documents is generally $250, but we discount when you do more than one, or if they are included as part of the Will.

• Durable business power of attorney (or, "Who is, and when can they make decisions about my stuff when I cannot.")
• Health Care Power of Attorney (or, "Who is, and when can they make decisions about my health care when I cannot.")
• Living Wills also known as Advance Directives (or, "How much can be done to save me.")
• Will to Live Power of attorney (or, "How much must be done to save me.")
• HIPAA Authorizations (or, "Who can see my medical information and tests.")
• Do Not Resuscitate Orders (DNR) (or, "What can and cannot be done to save me.")

Basic Estate Planning

• Development and implementation of an overall strategy - $2500 and up
• Planning for Medicaid or VA benefits - $3000
  • This includes a discussion of your income and assets,
  • Summary of the current qualification criteria (it changes regularly!),
  • How to qualify for the specific plans sought (income and asset protection, wills, trusts, and savings plans), and
  • Short and long-term strategies for getting you or your loved one to the qualification point.

Advanced Estate Plans - hourly basis only

• Prenuptial agreements
• Discussion of strategic use of Will substitutes
• Life insurance values and strategies
• Legacy gifting and planning
