Trusts
There are many kinds of trusts useful in planning. Some even work in crisis mode.
- Special needs trusts - useful to protect the beneficiary from receiving a large sum of money (such as from an inheritance or settlement) which makes them ineligible for further aid from Medicaid. Placing the funds into a special needs trust protects the funds and the person.
- Revocable trusts - Funds and assets can be placed into a revocable trust that provides control of assets, but prevents them from going through probate and also avoids making your assets public. This type of trust does not protect funds from Medicaid.
- Irrevocable trusts - This type of trust makes funds unavailable for control by the creator of the trust but it also is be best way to protect assets from being consumed by Medicaid. It also can create options for VA benefits. It is important to create a proper trust... one mistake will make it useless.
